Subject: Information pursuant to Articles 13 and 14 of the EU General Data Protection Regulation 679/2016 (GDPR).

Pursuant to and for the purposes of the aforementioned legislation, our Agency hereby wishes to inform you in advance of both the use of your personal data and your rights, informing you of the following:

 

1. DATA CONTROLLER

The data controller is Immobiliare Montecarlo Sas, with operational headquarters in Bordighera, via Vittorio Emanuele II° n° 214.

 

2. PERSONAL DATA SUBJECT TO PROCESSING

For the purposes of carrying out the activity of property consultancy and mediation, and to satisfy your request for services, we use certain data of the interested party. These are identification data, contact details (address, landline telephone number, mobile phone number, fax number, e-mail), data relating to the property, data relating to your economic capacity, land registry and property certificates, data relating to the composition of your household.

 

3. PURPOSE, LEGAL BASIS AND OBLIGATORY OR OPTIONAL NATURE OF PROCESSING

This data will be provided by the data subject and will be collected by our staff and collaborators, also by computer or telematic means, in order to be able to carry out the activity of real estate consultancy and mediation, to execute a service or a contractually agreed operation, to verify the progress of contractual relations as well as the risks connected with them.

It should be noted that the provision of such data is mandatory in the sense that, otherwise, we would not be able to perform, in whole or in part, the above-mentioned assignment/assignment, and that your data may also be collected from other parties. Certain information may also have to be disclosed by you or third parties due to legal obligations (e.g. under anti-money laundering regulations).

Your personal data will also be processed in order to fulfil the obligations laid down by state laws, regulations and EU legislation, or by provisions issued by authorities empowered to do so by law and by control or supervisory bodies. The relevant processing does not require the consent of the data subject.

The information relating to your property, including images, videos and floor plans thereof, shall also be processed for the purpose of carrying out the promotional and commercial practices aimed at the proper performance of the assignment/assignment entrusted, and may therefore be disseminated by means of

publication on websites, social networks and/or printed publications of the owner, subject to his express consent. Your e-mail addresses may be used by the data controller to send you commercial communications on products and services similar to those provided, pursuant to and in accordance with paragraph 4 of Article 130 of Legislative Decree 196/2003 as amended by Legislative Decree 101/2018.

You may object to this processing purpose at any time. Opposition will have no effect on the pursuit of the main purpose of carrying out the activity of property consultancy and mediation.

 

4. RECIPIENTS

Your data will be made available to our internal administrative staff and to our external collaborators, a list of whom is available at our offices, and will also be communicated to our service providers such as IT service companies, outsourcing companies, consultants and freelance professionals, insurance companies, debt collection companies, fraud control companies, agencies and/or patronage bodies, companies or bodies appointed by us as specifically responsible for processing and a list of which is available at our offices.

Furthermore, your data may be communicated to technicians for all the checks on the property of your interest to be carried out at the Technical Office, the Land Registry and/or other Institutions, Bodies or Registers.

 

5. TRANSFERS

Some of your Personal Data are transferred to recipients that may be located outside the European Economic Area. The Controller ensures that the electronic and paper processing of your Personal Data by the Recipients is carried out in compliance with the Applicable Legislation. Indeed, transfers are based either on the basis of an adequacy decision or the Standard Model Clauses approved by the European Commission. 6. DATA STORAGE

All personal data provided will be processed in compliance with the principles of lawfulness, correctness, relevance and proportionality, only by the means, including computer and telematic means, strictly necessary to pursue the purposes described above. In any case, personal data will be kept for a period of

time no longer than is strictly necessary to achieve the purposes indicated. Personal data whose storage is not necessary in relation to the purposes indicated will be deleted or transformed into anonymous form. Please note that the information systems used to manage the information collected are configured, from the outset, to minimise the use of data.

 

7. YOUR RIGHTS

Finally, you are reminded that in your capacity as data subject, you have the rights set out in Article 15 GDPR and specifically the rights to:

I. obtain confirmation of the existence or otherwise of personal data concerning you, even if not yet registered, and its communication in intelligible form;

II. obtain indication of

b. the purposes and methods of the processing

c. the logic applied in the event of processing carried out with the aid of electronic instruments

d. the identity of the data controller, data processors and the representative designated pursuant to Article 3(1) of the GDPR;

Where applicable, you also have the rights set out in Articles 16-21 GDPR (Right to rectification, right to be forgotten, right to restriction of processing, right to data portability, right to object), as well as the right to complain to the Data Protection Authority.

The undersigned declares that he/she authorises the Estate Agent/Agency, the Data Controller, to disseminate information and photos, videos and plans relating to the property he/she owns through websites, social networks and/or printed publications.

The undersigned declares that he/she authorises the Estate Agent/Agency, the Data Controller, to send advertising or informative material relating to the commercial sector for promotional, statistical and cognitive purposes.
